Drinking water, a vital resource for human survival, has been at the centre of <\/span>an important regulatory transformation<\/b> with the entry into force of Legislative Decree 23 February 2023, no. 18. This provision, implementing Directive 2020\/2184\/EU, constitutes a significant update to Italian legislation on water intended for human consumption, repealing the previous Legislative Decree 31\/2001 and proposing <\/span>a new approach to water quality and safety management<\/b>.<\/span><\/p>\n

Purpose and scope of the latest Drinking Water Decree<\/strong><\/h2>\n

The <\/span>Legislative Decree No. 18 of 2023<\/span><\/a> aims at <\/span>ensure that drinking water is <\/b>\u201cHealthy and clean\u201d<\/i><\/b>, improving quality and reducing the risks associated with consumption. Article 2 of the decree clearly defines what is meant by \u201cwater intended for human consumption\u201d, including treated or untreated water intended for domestic uses, for the preparation of food and beverages, and incorporated into food during production. This definition covers various sources, whether they are distribution networks, tanks, bottles, or containers, and also includes spring water.<\/span><\/p>\n

Article 3 specifies the exemptions, which relate to natural mineral waters, medicinal waters and those intended exclusively for specific non-drinking uses. These exclusions highlight a targeted approach, recognising the normal variations in water quality and use across different applications.<\/span><\/p>\n

\"drinking<\/p>\n

General obligations for water quality<\/strong><\/h3>\n

Legislative Decree No. 18\/2023 states that water intended for human consumption must not contain microorganisms, viruses, parasites or other substances in quantities <\/span>that pose a health risk<\/b>. This implies strict adherence to the microbiological and chemical parameters listed in Annex I of the decree. Furthermore, the measures necessary to ensure clean water must not lead to a deterioration of the existing quality or an increase in water source pollution.<\/span><\/p>\n

The decree requires water utility operators to conduct network efficiency assessments and explore improvements to reduce water losses, with a particular focus on those suppliers managing at least 10,000 m\u00b3 of water per day or serving at least 50,000 people. This approach not only improves resource management but <\/span>promotes environmental sustainability for the future<\/b>.<\/span><\/p>\n

Water Safety Plan: Risk Assessment and Management<\/strong><\/h3>\n

A key element of Legislative Decree n. 18\/2023 is the introduction of<\/span> \u201cWater safety plan<\/b>\u201c, which implies a risk-based approach to ensure water quality. This plan encompasses risk assessment, management, and communication, aiming to protect water resources from physical, chemical, and biological threats, including climate change.<\/span><\/p>\n

Risk assessment covers crucial aspects such as the <\/span>feeding areas<\/b>, i <\/span>sampling points<\/b> and the entire <\/span>drinking water supply chain<\/b>from internal distribution systems to storage systems. It collaborates with health authorities for a holistic control of significant hazards and risks, prioritising the most cost-effective measures.<\/span><\/p>\n

\"Drinking<\/p>\n

Protection and regulation of contaminants<\/strong><\/h3>\n

Legislative Decree 18\/2023 states<\/span> stricter limits for specific contaminants<\/b>, with particular attention to per- and polyfluoroalkyl substances (PFAS) and trifluoroacetic acid (TFA). These measures are part of a broader intention to protect public health, considering the growing awareness of the environmental impact of these substances.<\/span><\/p>\n

The decree also imposes a <\/span>continuous monitoring for chemical and microbiological substances<\/b>, with an analysis frequency that ensures a timely response to any quality breach. This also extends to drinking water analyses in pools and groundwater, ensuring the entire system is monitored and protected.<\/span><\/p>\n

New bodies for water security<\/strong><\/h3>\n

To implement the new provisions of Legislative Decree 18\/2023, two new bodies are established: the <\/span>CeNSiA<\/b> (National Centre for Water Safety) and the\u2019<\/span>AnTeA<\/b> (Dynamic Territorial Register of Drinking Water). These bodies are responsible for the national supervision of water quality and safety and the management of spatial data on water resources. They contribute to a reactive and coordinated response to emerging problems, ensuring more effective governance of water resources.<\/span><\/p>\n

Communication and responsibility for citizens<\/strong><\/h3>\n

The decree introduces a <\/span>new level of transparency in communication to citizens<\/b>by requiring water suppliers to disclose annually, through bills or electronic means, <\/span>details on water quality and the checks carried out<\/b>. This communication system aims to give citizens more control over the resources they use.<\/span><\/p>\n

Condominium administrators, who are responsible for plumbing systems, must carry out risk assessments and comply with analytical parameters, and are responsible for implementing preventive measures. Significant fines, ranging from EUR 4,000 to EUR 24,000, are envisaged in the event of violations.<\/span><\/p>\n

Frequency and routine of controls<\/strong><\/h3>\n

Legislative Decree 18\/2023 requires <\/span>control programmes on the drinking water supply chain<\/b> in cooperation with local health authorities and agencies of the National Environmental Protection System. Controls are divided into external (carried out by the operator) and internal (carried out by health authorities), ensuring that there are no gaps in continuous quality monitoring. This system of regular checks is essential to maintain the safety of drinking water and quickly identify potential problems.<\/span><\/p>\n

Drinking water analyses<\/strong><\/h3>\n

Microbiological and chemical analyses of drinking water are f<\/strong><\/span>ondamental to controlling quality and preventing risks to human health<\/b>. An example that highlights the importance of these analyses is the monitoring of Escherichia coli (E. coli), a bacterium that indicates faecal contamination. The presence of E. coli is unacceptable in drinking water and represents an immediate risk. Similarly, the decree imposes strict control over arsenic levels, a toxic element that must be kept below 10 \u00b5g\/l to prevent adverse health effects. Such analyses, carried out by certified laboratories, ensure that the water complies with regulatory requirements.<\/span><\/p>\n

Key parameters for water potability<\/strong><\/h3>\n

to ensure that drinking water is safe, the decree requires <\/span>verification of 53 key parameters<\/b>, including microbiological, chemical, indicator, and radioactivity. These parameters ensure that the water is free from dangerous contaminants and meets normal conditions for human consumption. For example, the pH control of water must be maintained between 6.5 and 9.5 units to ensure not only safety but also the taste of the water, preventing corrosion of distribution infrastructure and ensuring it is acceptable to the consumer. Similarly, the indicative total dose of radioactivity must be kept below 0.1 mSv\/year, to prevent any health risks from radiation.<\/span><\/p>\n

The future of drinking water in Italy<\/strong><\/h3>\n

In this article, we saw how Legislative Decree No 18 of 23 February 2023 marked a significant step forward in protecting the quality of drinking water in Italy. With strict regulations and continuous monitoring, the decree promotes the safety and sustainability of the water system.<\/span><\/p>\n

It is important to mention that a <\/span>proposal for a decree correcting legislative decree 18\/2023<\/span><\/a>. This amendment, with new additions planned for May 2025, will introduce <\/span>tighter restrictions on perfluoroalkyl substances (Pfas)<\/b> and n<\/span>ew rules for the production of materials in contact with water<\/b>, which will come into effect on 12 January 2026, demonstrating the regulatory evolution aimed at safeguarding public health.<\/span><\/p>\n
